Corporate Accountability

After reading an article about this I am still unclear. Does anybody have any opinions as to who will be prosecuted and under what circumstances?

Corporate accountability should fall out from your company safety policy, but I think the buck stops at the top






your Health and safety policy should indicate who has responsibilities within the organisation for Health and Safety, the ultimate responsibility lying with the MD or CEO. A Director for Safety should be nominated whose responsibility it is to ensure the policy is complied with.over and above this though is the responsibilities of the body corporate . ie any person acting in the role of "Manager" - see sect 36,37 of HASAWA. this could include directors, managers team leaders etc.

I should be well aware as I am always trying to tell people that the senior manager/CEO chief exec etc may one day be in court, it is one thing to say that and another to really believe it.

However this thread prompted me to check out the HSE prosecution database and I was surprised to see so many cases that had been taken under Section 37. I feel a PowerPoint presentation coming on to the Management Board !!
