is it an LTi or not

Could somebody please advise on the following situation, is it an LTi or not

An employee is employed to work between 8am and 6pm, work ceases at 5:45 with the final 15 minutes of the day allocated to time to change into personal clothing and report to the bus for transport to home. Between clocking off (5:45) and attending the bus (6:00) the employee trips and falls and fractures their ankle.

Is this considered a recordable accident or is it a non-work related injury?

My opinion is that as he was on company property, during hours in which he is paid to be there that it should be classed as a recordable injury as an LTi. Colleagues argue that he had finished working that it should not be classed as a recordable injury.

Other information is that the individual slipped through lack of attention rather than an unsafe condition.

The working day was 8 till 6, but as part of the employees contract they are required to attend the site to be able to work, so you could at a push argue that until they reach home an accident experienced is work related, (if they were not at work, then they may well have not been exposed to the potential accident) But in this case, I would say definitely yes it is a work related accident, the question over report ability under RIDDOR, would come in if they did not attend work for the next shift and sited the accident as the reason. Either way you need to record, investigate and put in corrective measures, even if they are - talk to the council/people responsible for foot paths if the incident occurred off site.

The point over lack of attention is mute, what was he/she required to concentrate on - could the company have improved conditions in terms of training and awareness. Lack of attention gets into apportioning blame – yes the individual had the responsibility for his/hers own safety, but the company shares in that responsibility (Still work related)

Hi Barry,

Many thanks for you input in this scenario Very Happy . It is made more interesting by the fact that this incident occurred in Azerbaijan (Former Soviet Union) where national safety regulations are printed on green pieces of paper with the pictures of dead American presidents.

The location of the incident was outside the boundaries of the western company operating the facility but within the boundaries of the state oil companies land, these are individuals whom only apply safety if it is paid for by others and is only applied until such time as the objects or equipment provided by others can be sold in the local markets Smile

You would never believe some of the things I have witnessed here in the last 7 years Shocked
