Company deserted its own standards allowing site accident
The minerals, mining and manufacturers Imerys Group has been prosecuted and fined over the circumstances of a December 2005 accident that occurred at Par Docks, Cornwall, in which a vehicle raised its load carrying section and contacted overhead power cables.
The incident, which had the potential to claim lives, happened only because the company had departed from the requirements of its own safety documentation requiring appropriate precautions to be in place where such a hazard existed, measures such as those described in the HSE guidance (see overhead power lines).
Liskeard Magistrates fined the company a total of £5,000, with costs exceeding £1,500, after it admitted breaching the Management of Health and Safety at Work Regulations 1999 and the Electricity at Work Regulations 1989.
