Prosecution of companies after workplace transport accident

Aggregate Industries UK Limited (Bardon Contracting division) and Tripod Crest Planing Limited have been prosecuted and fined for breaching the Health and Safety at Work etc Act 1974 as a result of failures to adequately control the risks arising from vehicle movements at a project on South Lambeth Road, London, on the night of 14th January 2003, an outcome of which was the severe injury of a Bardon Contracting employee.
The accident victim was marking a driveline on the road surface for the Tripod Planing machine to follow, but with his back turned he did not see a lorry from Tripod's haulage subcontractor reversing towards him, which struck him, crushing his legs.
Both companies pleaded guilty to charges under the Principal Act, each was fined £25,000 at the Central Criminal Court in London.

Comment:
"Most of the men on site had worked together before. However, despite both Bardon and Tripod having recognised the risk of injury from reversing vehicles, and taking account of this in their method statements, the visiting lorry driver received no site induction about safe reversing from either company on site." - HSE Inspector.
