Canadian company fined $90K over forklift fatality.
Canadian oil purification systems supplier, Filtervac International Inc of Breslau, Ontario, has been fined $90K (£41,284) at court in Kitchener for violations of the Occupational Health and Safety Act in respect of a fatal accident involving a forklift truck.
On 28th March 2005, a worker operating a forklift truck, moving a heavy fabric bag containing clay removed from filter cylinders, found the vehicle became unstable when it struck a kerb concealed by snow. The instability of the load led to the forklift beginning to tip over, and as the driver attempted to leap clear he was struck and pinned by the rollover cage.
Ministry of Labour Investigation established that the worker had not been trained in forklift operation and had no authorisation to drive it. The company rule that only trained forklift drivers operated the vehicles was not strictly enforced, nor was there effective control of access to forklift keys.
The company pleaded guilty as an employer to failing to ensure that the forklift could only be operated by a worker authorised for this task, this being contrary to S.25(2)(h) of the act.
